The Dividing Fences Act 1991 provides a process for dealing with matters such as fencing work, standards and costs. But before arguing about who should pay, there is one important question to answer:

Is the existing fence on the legal boundary?

A fence that has stood for decades is not automatically proof of the boundary.

A boundary identification survey can:

  • Establish the legal property boundary

  • Show how the existing fence relates to it

  • Identify potential encroachments

  • Give both neighbours reliable evidence

  • Help prevent a new fence from being built in the wrong position
